The research paper should represent the independent and original work of each student in an area of legal inquiry studied or discussed in the course. Being the most important component in the paper, an ideal analysis will focus on the core legal issue(s) embedded in your topic, will evidence clear insights, and will perhaps also tie in interdisciplinary issues such as ethics and economics. Your analysis may refer to readings, cases or discussions from class, if relevant. Importantly, analysis means more than restating what your research articles report; analysis is breaking down the most essential arguments that are relevant to your topic, evaluating them and helping the reader understand them. Synthesis refers to tying together the major considerations from all sources used in your research and demonstrating understanding and insight.
The major opposing or clashing viewpoints of the topic you are researching should be discussed objectively (i.e. the reader should not be able to discern your personal opinion of the topic).
Conclusion: (15 points)
The strongest Conclusions make incisive recommendation(s) for how your topic could be resolved in a balanced, pragmatic and prudent manner. Making a recommendation is how scholarly papers should end. References: A total of 15-20 quotations would be sufficient (cases, statutes, and/or law review articles are recommended as sources, as opposed to magazine or newspaper articles).
4. Foot or Endnotes: Each quotation should cite the source by identifying the author’s name or the case name through a (parenthetical) reference (or with a footnote or endnote).
5. Bibliography of Sources Format: title, author, date of publication, page of cite, or name, year and jurisdiction, if a case. (APA, MLA, or Bluebook format is acceptable).
